These Terms and Conditions (“Terms”) govern your access to and use of the Website, as well as any inquiries, sample requests, orders, or other interactions you have with us through the Website or related channels.

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website.

Important: Our Anti-Fall Flooring is designed to reduce the risk and severity of certain fall-related injuries, but no flooring system can prevent all falls or injuries. See Section 10 (Disclaimers) for more details.

1. Eligibility and acceptance of terms

• You have the legal capacity to enter into a binding agreement with us.

2. About Mann Materials and our products

2.1 Mann Materials designs, markets and supplies Anti-Fall Flooring and related products designed to help reduce the risk and severity of impact injuries from falls in residential and commercial environments.

2.2 Product information (including photos, videos, brochures, test data and descriptions) is provided for general information purposes only. We make reasonable efforts to ensure accuracy, but:

• Actual product appearance, colour and specifications may vary from photos or samples;

• Installation quality, sub-floor conditions and real-world use can affect performance.

2.3 Nothing on the Website is intended to replace professional building, medical, clinical, occupational therapy or safety advice. You are responsible for ensuring that our products are suitable for your specific project, local regulations, and any building or healthcare standards that apply.

• May change at any time prior to order confirmation.

5.3 Where purchases are made directly from us:

• Payment terms will be specified in the quotation, invoice or order confirmation;

• Orders are accepted subject to availability and our confirmation;

• We may require prepayment or deposits for certain orders, custom production, or large quantities.

5.4 You are responsible for any customs duties, import taxes, brokerage fees or other charges applicable in your country unless otherwise agreed in writing.

6.2 Any delivery times or dates we provide are estimates only. We are not liable for delays caused by:

• Logistics providers, customs clearance, port congestion or force majeure events;

• Shortages of materials, production delays or other circumstances beyond our reasonable control.

6.3 Risk of loss or damage to products typically passes in accordance with the agreed Incoterms or shipping terms. You should inspect products promptly on arrival and notify us (and the carrier, where applicable) of any visible damage or shortages within the time limits specified in the contract or applicable law.

7. Installation and third-party installers

7.1 Proper performance of Anti-Fall Flooring depends heavily on:

• Correct sub-floor preparation;

• Correct installation methods;

• Compliance with our installation guidelines and local building standards.

7.2 Installation is often performed by independent third-party installers, contractors or builders who are not employees or agents of Mann Materials. We are not responsible for:

• Workmanship or quality of installation;

• Advice or representations made by third-party installers;

• Any damage or injuries arising from incorrect installation, misuse or modification of our products.

7.3 If we provide a list of installers or contractors, this is for your convenience only and does not constitute a guarantee or endorsement. You should perform your own due diligence before engaging any installer.

8. Samples, testing and performance data

8.1 Any product samples provided are for evaluation and demonstration purposes only. Performance of samples under controlled conditions may differ from real-world conditions.

8.2 Impact absorption data, test results, clinical or laboratory studies, and case studies that we publish:

• Are based on specific test methods, conditions and assumptions;

• May not reflect every environment or use case;

• Do not guarantee identical results in your particular project.

8.3 You are responsible for determining whether our products meet:

• The requirements of your building, facility or project;

• Applicable laws, regulations, building codes and safety standards in your jurisdiction.

We recommend consulting with appropriate professionals (e.g. engineers, architects, clinicians, occupational therapists, safety officers) where relevant.

9. Intellectual property

Our Anti-Fall Flooring is designed to reduce the risk and severity of certain fall-related injuries compared with conventional hard flooring under defined test conditions. However:

• Actual outcomes depend on many factors, including user health, environment, footwear, mobility aids, installation quality, and the circumstances of each fall.
